Offence
63 (1) A person commits an offence who does any of the
following:
(a) willfully and without lawful excuse pulls down,
defaces, alters or removes a staking or legal post, a legal corner post
or other survey monument;
(b) explores for, develops or produces minerals contrary
to this Act or the regulations;
(c) knowingly makes a false statement or provides false
information under this Act or the regulations, or in a registration;
(d) offers for sale, or sells, a mineral title for a
non-mining usage.
(2) Sections 4 and 5 of the Offence Act do not apply to this
Act.
(3) A person who is convicted of an offence is liable to a fine
of not more than $25 000 or to imprisonment for not more than 6 months,
or to both.

Q: What is a mining claim?
A: A mining claim is a surveyed parcel recorded with the Provincial Government that gives the owner the right to access, explore, occupy and develop its underlying minerals.

Q: If I buy a mining claim, how long do I own it for?
A: As long as your claim is renewed before its expiry date it’s yours for good. Keep your property in good standing by paying the yearly fees due. A claim is made up of 1 or more cells, and an individual cell is approximately 40 acres, give or take, depending on the proximity to the equator. Each mineral cell is approximately $100/year in fees and each placer cell is approximately $250/year in fees, more or less, depending on size. If improvements are made, or exploration work performed, the value of the work may be submitted online in lieu of the majority of this fee.

Q: What is the difference between a Mineral Claim and a Placer Claim?
A: Minerals vary in the way they are deposited. A mineral claim is used when the target minerals occur in hard rock, such as gold bearing quartz veins. A placer claim is used when the target minerals occur in loose gravels, such as gold or platinum nuggets, jade boulders, etc.

Q: Can I sell my claim in the future?
A: Yes, you can sell or lease it out anytime.

Q: Where can I get more information on Mining?
A: The internet, library, Geological Survey of Canada and British Columbia Geological Survey are great places to start.

Q: What if I am contacted by a mining company to develop my claim?
A: If your claim covers ground currently targeted by mining companies, you may receive a financial offer to sell or lease the rights to your claim. You may wish to retain a net smelter return (NSR), which is a royalty or percentage paid to you based on of the value of the minerals developed.

Q: I am interested in buying a Mining Claim listed on this website, what’s next?
A: Email or call us with your offer and to reserve your claim, they are sold first come first serve. Title is transferred immediately upon funds being cleared.
